Norwegian Court Overturns Decision After AI-Generated Errors in Tax Dispute

The Gulating Court of Appeal nullified a lower court ruling on Ineos' property-tax case, citing misquoted arguments and AI involvement.

Gulating laglagmannsrett has set aside a decision by Hardanger and Voss tingtingrett in the long-running property-tax lawsuit between chemical firm Ineos and Ullensvang municipality. The appeal court found that nine sections of the original judgment mischaracterized Ineos' submissions and failed to address arguments the company actually made. The district court acknowledged that artificial intelligence was employed as an aid in drafting the decision, but the presiding judge remained accountable for the final text.

Ullensvang also confirmed its points were misquoted. Consequently, the case will be retried, with the appellate court emphasizing a procedural error regardless of whether AI caused it. The court is also drafting new guidelines on AI use, expected by October.
