Oslo court upholds state decision to halt three Colombian adoptions

Oslo District Court ruled that the state was justified in stopping three adoptions from Colombia after the adoption authority failed to properly notify the biological parents.

In a recent decision, Oslo District Court dismissed a lawsuit filed by the adoption organization Adopsjonsforum against the Norwegian state. The case stemmed from Bufdir's suspension of three Colombian adoptions, which the court upheld on the grounds that the biological parents had not received personal notification or multiple attempts at contact. Notification was reduced to a single posting at a local office for one working day, which the court deemed insufficient.

Consequently, the state was cleared of liability, and Adopsjonsforum was ordered to pay the legal expenses. The ruling aligns with a June investigation that highlighted illegal or unethical practices in foreign adoptions to Norway, prompting Adopsjonsforum to issue a strong apology to those affected.

Why it matters

The decision clarifies legal standards for notifying birth parents in international adoptions, impacting future adoption procedures.
