Parliament debates staged refunds for pensioners taxed under progressive rates

A Senate bill proposes returning part of the progressive tax withheld from pensions between early 2024 and early 2025 in three installments through March 2028, with several pensioner groups excluded.

Legislators have introduced project B570/2026 to reimburse pensioners whose pensions were subject to a progressive tax from 1 January 2024 to 30 January 2025. The plan schedules three disbursements: 10% of the total owed in December 2026, 40% in March 2027 and the final 50% in March 2028, all paid automatically through the existing pension distribution system. The Casa Națională de Pensii Publice and the relevant sectoral pension houses will handle the payments, adjusting any excess against future tax liabilities.

The proposal excludes groups such as military retirees covered by article 60 of Law 223/2015, judges under articles 211 and 213 of Law 303/2022, court clerks, and other public officials listed in the bill, provided the progressive tax did not lower their net income. It also sets a recalculated tax rate of 10% on monthly taxable income, with a non-taxable allowance of 2,000 lei for January-September 2024 and 3,000 lei for October 2024-January 2025. The law is still pending parliamentary approval before it can be promulgated.

Why it matters

The measure determines whether thousands of Romanian retirees will see a portion of previously withheld taxes returned.
