Pennsylvania Governor Pushes Sweeping Health-Code Changes Granting Broad Police Powers
Governor Josh Shapiro is proposing a massive overhaul of Pennsylvania’s health code that would let the state health department enter homes and schools without a warrant and impose mask and vaccine mandates.
A 502-page regulatory package released on August 8 would rewrite Pennsylvania’s health code, giving the Department of Health centralized police powers under the governor’s office. The changes would let health officials enter apartments, schools or other facilities without a warrant, seize confidential medical data, and enforce mask, distancing and vaccination requirements even when no infectious disease is present. The bill also adds a vague category of "condition," potentially covering non-infectious ailments, and creates a mandatory statewide vaccine reporting system.
Lawmakers such as Michele Brooks have warned that the measure overturns a 2021 voter-approved amendment that capped emergency declarations at 21 days unless the legislature extends them. The proposal follows Shapiro’s role as the chief enforcer of former Governor Tom Wolf’s COVID restrictions, which many voters opposed during the pandemic.
