Pennsylvania revives historic fight against pinball-style gambling devices

The Pennsylvania Supreme Court has ruled that modern electronic “skill games” are legally slot machines, opening the door for law-enforcement seizures similar to the 1940s crackdown on pinball machines.

In June, the Pennsylvania Supreme Court declared that electronic skill-game machines function as slot machines, prompting a potential wave of confiscations unless lawmakers enact new regulations. This mirrors a decades-old campaign against pinball machines, which police in the 1940s argued were gambling devices that fostered gang violence and attracted youth to illegal activity. Historical rulings from the Superior Court in 1942 and the Supreme Court in 1959, which labeled pinball as intrinsically linked to gambling, were referenced in the recent decision.

Police seized six pinball machines from a Frankford Avenue restaurant after observing a patron win free rounds and exchange them for cash. The modern crackdown could affect devices in corner stores, gas stations and bars across Pennsylvania, reviving a long-standing legal debate over what constitutes gambling equipment.

Why it matters

The ruling could reshape the legality of popular arcade-style games and affect thousands of small businesses in Pennsylvania.
