Philippines regulator proposes mandatory one-year warranty for refurbished phones

The National Telecommunications Commission is drafting rules that would require a one-year repair or replacement warranty on refurbished mobile devices sold by licensed dealers.

The National Telecommunications Commission said it is preparing regulations that would obligate licensed dealers of refurbished mobile phones to provide a mandatory one-year repair or replacement warranty. The draft rules aim to guarantee that such devices are sold by authorized vendors, are legitimately sourced, compatible with Philippine mobile network operators, properly sanitized, and accurately graded for condition.

Commercial sellers applying for a Dealers Permit for Used, Reconditioned, or Refurbished Mobile Devices must meet a minimum capitalization requirement to ensure they can honor warranties. The NTC clarified that private individuals may still buy and sell their own devices in non-commercial amounts without restriction. The agency also intends to introduce procedures for the proper recycling and disposal of devices that cannot be repaired. A public hearing on the proposal was held on September 23.

Why it matters

The rules aim to protect Filipino consumers from unsafe or stolen refurbished phones and ensure dealers can honor warranty claims.
