Polish government adopts rules to enforce EU Data Act on internet-connected devices

Poland has approved a draft law that will implement the EU Data Act, granting users of IoT devices rights to access and share data while placing oversight with the head of the UKE.

A government-backed draft law seeks to transpose the European Union's Data Act into Polish law, ensuring that data produced by internet-connected devices can be accessed and reused by consumers, businesses and public authorities. Users will be able to request their device data and to permit its transfer to service providers such as repair firms. Oversight responsibilities, including complaint handling and the imposition of fines, will rest with the President of the Urząd Komunikacji Elektronicznej, who will also act as the data coordinator.

Dispute-resolution entities must obtain a five-year certification confirming their independence and expertise. The Minister of Digitisation will fulfil reporting duties toward the European Commission. The provisions are slated to take effect three months after their official announcement in the Dziennik Ustaw.

Why it matters

It gives Polish consumers and businesses enforceable rights to access data from connected devices and creates a clear regulatory framework.
