Polish Media Council Appeals Prosecutor's Refusal to Probe Public Broadcasters' Liquidation

The National Broadcasting Council said it will appeal the Warsaw prosecutor's decision not to open an investigation into the alleged liquidation of public broadcasters.

On Monday the National Broadcasting Council (KRRiT) announced that the Warsaw District Prosecutor's Office refused to initiate an investigation into what it calls a fictitious liquidation of Poland’s public media. The council intends to submit an appeal to the court, asserting that the alleged winding-up of TVP, Polskie Radio and its regional outlets may violate the constitutional framework and has resulted in significant financial, organisational and reputational losses.

Chairwoman Agnieszka Glapiak, who filed a complaint with the prosecutor in April after noting the illegal December 2023 takeover of public media and subsequent court rulings confirming their liquidation, said the prosecutor must also examine possible breaches of state constitutional order. She stressed the need for transparency and accountability, warning that one outlet situation undermines public trust in key state institutions. KRRiT’s complaint seeks clarification on whether the companies operating in liquidation are merely maintaining a legal fiction.

Why it matters

The case could determine the legal status and independence of Poland's public broadcasters.
