Queensland Health revises fertility clinic rules to treat lesbian couples as one family

Queensland Health has issued revised guidance for fertility clinics, overturning an earlier policy that classified lesbian couples using the same donor as two separate families. The original interpretation had caused treatment delays for multiple same-sex couples and required a woman to obtain government approval to use her own embryos. Chief Health Officer Marianne Gale acknowledged the potential for unintended consequences and said the family-limit rule would be applied differently from 1 March 2026 onward.

The updated guidance now treats a same-sex couple sharing a donor as a single family, a change welcomed by fertility lawyer Stephen Page and LGBTQ advocacy groups as a significant win. Couples such as Kate Cantrell and Jessie Fraher expressed relief that future families will no longer face the same obstacle. While the revision addresses the immediate issue, advocates note that guidance for separated parents using the same donor remains unclear.
