The lawsuit, filed on March 25, alleges Nacua made anti-Semitic statements and bit Atiabi’s shoulder while they were traveling in a sprinter van following a New Year’s Eve gathering. Atiabi seeks damages for gender-based violence, assault, battery and negligence.
Nacua’s counsel acknowledges the bite but frames it as mutual horseplay, rejecting claims of hateful remarks. The judge labeled the date “firm” and warned that any continuance must be justified. The trial is projected to last about six days, with a final status conference set for March 14, 2028. Nacua has previously entered rehab and expressed a desire to learn from the incident.
