Romanian Constitutional Court to review PSD leader's challenge to SAFE emergency ordinance

The Constitutional Court of Romania will hear a petition from Sorin Grindeanu alleging that the Bolojan government issued an emergency ordinance on the SAFE program beyond its constitutional powers.

The Constitutional Court of Romania is set to consider a petition filed by Sorin Grindeanu, head of the Chamber of Deputies, concerning the legality of emergency ordinance no. 38/2026 on the SAFE program. Grindeanu contends that the Bolojan cabinet, having been dismissed by a parliamentary motion of no confidence, lacked the constitutional competence to issue such a legislative act and should have been limited to routine administrative tasks.

He further asserts that the ordinance covers matters for which parliamentary bills were already in progress, thereby usurping the Parliament's exclusive law-making role. The petition asks the Court to declare the ordinance unconstitutional and to prevent the executive from issuing primary-law acts while it is only performing administrative duties. It also seeks affirmation of Parliament's right to continue its legislative procedures on the affected topics. The Court postponed its decision to a later date in October.

Why it matters

The ruling could clarify limits on a caretaker government's legislative powers in Romania.
