Sejm leader warns President over Berek's constitutional court appointment

Zbigniew Bogucki, head of the President’s Chancellery, wrote to the Sejm requesting formal clarification of Maciej Berek’s nomination to the Constitutional Tribunal, citing doubts about his ten-year legal practice requirement. Today, Sejm Marshal Włodzimierz Czarzasty announced that the Sejm’s office will answer the President’s office and reiterated that the President lacks legal standing to challenge the Sejm’s sovereign choice, as it would upset the constitutional separation of powers.

Czarzasty emphasized that the President’s role is to represent the nation, while the Sejm enacts laws and appoints officials. He urged the President to accept Berek’s oath, warning that refusal would repeat a prior unconstitutional situation and could trigger further action. Bogucki stressed that unresolved doubts about Berek’s qualifications should be settled before any oath is taken, to preserve the legitimacy of the Tribunal’s decisions.
