SET rejects request to overturn quo warranto case against Senator Erwin Tulfo
The Senate Electoral Tribunal denied a motion to reconsider the dismissal of a quo warranto petition aimed at removing Senator Erwin Tulfo over alleged citizenship issues.
The Senate Electoral Tribunal (SET) voted six members in favor and three against to reject a motion for reconsideration of its earlier dismissal of a quo warranto petition targeting Senator Erwin Tulfo. The petition, filed by Berteni Cataluña Causing, alleged that Tulfo was ineligible because of alleged American citizenship, alleged disloyalty, and other qualifications. SET officials said the amended petition did not comply with the filing and service requirements of the 2020 SET Rules and was submitted after the deadline, rendering it insufficient in form.
While the tribunal denied the motion, it left open the possibility of filing a new petition that meets procedural standards. The case follows earlier disqualification attempts, including a libel conviction claim and a Comelec dismissal of related petitions.
Why it matters
The ruling keeps Senator Tulfo in office and highlights procedural hurdles in challenging elected officials' eligibility.
