Spain Tightens Rules on Short-Term Rentals, Requiring Proven Need

The housing ministry approved new regulations that force short-term rentals to demonstrate a genuine displacement reason, or they will be reclassified as permanent housing contracts.

During the latest cabinet meeting, the Ministry of Housing pushed through two royal decrees to tighten control over seasonal rentals, which critics say have been used to evade rent-control limits. Minister Isabel Rodríguez explained that the 2023 law left gaps that let owners label long-term stays as temporary to avoid tenant safeguards. The new decree mandates that a short-term lease include a real, documented reason for the tenant’s displacement and limits the term to a minimum of 31 days and generally no more than 12 months.

Should a contract run longer without justification or more than two back-to-back agreements be signed for the same dwelling, the arrangement will be treated as a regular residential lease with all associated rights. The regulation also strips temporary status from any lease lacking a stated cause, aiming to align legal protection with the actual use of the property.
