A bench comprising Chief Justice Surya Kant, Justice Joymalya Bagchi and Justice V Mohana issued an interim order directing that no teacher be appointed or absorbed unless they possess the requisite central qualifications. Senior advocate Ranjit Kumar argued that the law creates a non-competitive route that violates Articles 14 and 16 of the Constitution. The court referenced a recent 2026 ruling in Najma Khatun v. State of West Bengal, which condemned similar opaque appointments as a “blot on the system”.
