Supreme Court to hear NBCC's request for RERA exemption on stalled Supertech projects
The Supreme Court will consider NBCC Ltd's plea for relief from RERA rules as it seeks to finish 16 halted Supertech housing projects.
The Supreme Court agreed to review a petition by state-owned NBCC Ltd seeking exemption from specific RERA obligations while it undertakes the completion of 16 stalled Supertech residential projects. The matter was taken up by a bench comprising Chief Justice Surya Kant and Justices Joymalya Bagchi and V Mohana, which has called for responses from the Centre and former Supertech director Ram Kishor Arora. The request follows an NCLAT decision that refused to grant the exemption, stating it was not empowered to override statutory requirements.
NBCC plans to execute the projects in three phases covering sites in Uttar Pradesh, Uttarakhand, Haryana and Karnataka, affecting roughly 27,000 homebuyers awaiting possession. The hearing is scheduled for September 24 alongside other pending issues.
