Technical error triggers early start of higher tobacco tax in Germany
A mistake in the tax law makes the increased tobacco levy effective from Wednesday at midnight instead of the planned later date, prompting urgent action by the finance ministry.
A technical dating error in the recently published tobacco tax amendment causes the higher levy to take effect at 00:00 on Wednesday, contrary to the originally intended schedule. The error escaped detection during the entire drafting phase and was only admitted after a media inquiry, with officials confirming a correction is underway. Michael von Foerster, head of the tobacco association VdR, described the mishap as amateurish and harmful to domestic producers, urging the finance ministry to issue a clarification allowing continued production.
In response, the ministry dispatched an emergency letter to the Generalzolldirektion, informing customs of the situation; customs officials indicated they will not apply the new rule for now. Consequently, the higher rates cannot be implemented until new tax banderoles are printed, even though the law outlines a four-step increase through 2030, eventually raising the average price of a 20-pack by about 12 euros.
Why it matters
The error could disrupt tobacco manufacturers and delay the planned tax increase, affecting revenue and industry operations.
