Toddler's family files $18 million lawsuit over fatal high-rise window fall
The parents of a nearly two-year-old who died after falling through a bedroom window in a North York high-rise have sued the building’s owners and managers for $18 million, alleging negligence.
In August, the family of a toddler who fell to her death from a fourth-floor bedroom window in a North York apartment sued the building’s owners, GH Capital Corporation and 373041 Ontario Limited, along with two property managers, seeking $18 million in damages. The claim says the child was playing with her parents when she brushed a window that shattered without warning, and the parents were too close to catch her. The lawsuit alleges the management installed thin, unsafe glass, failed to install safety locks, and ignored prior repair requests despite awareness of similar incidents.
It further asserts that the parents and grandparents continue to endure severe depression, anxiety, and nightmares. Representing the family, lawyer Michael Smitiuch said the action is intended to raise public awareness of apartment-building safety risks. Both the owners and the defendants’ counsel have declined to comment.
