Venezuelan man charged after ICE officer shoots him in Austin

Wilber Rafael Garces Perez, a 28‑year‑old Venezuelan delivery driver, was shot by an ICE officer during a traffic stop in Austin on September 20 after police say his vehicle struck an officer with its side‑view mirror. Following the incident, the Justice Department filed a federal complaint charging him with assaulting, resisting, interfering with and impeding a federal officer. He remains in custody of U.S. marshals after being transferred from a detention center in South Texas.

The filing includes body‑camera still images but no video of the shooting. Prosecutors note the charges carry a potential sentence of up to 20 years.
