Ceuta files Supreme Court appeal over lack of migrant expulsions after July influx

The Ceuta government will submit a constitutional-administrative appeal to the Tribunal Supremo, accusing the national government of failing to carry out any expulsions of migrants who arrived in late July.

After the large-scale arrival of migrants on 30 and 31 July, Ceuta's administration intends to present a contentious-administrative petition to the Tribunal Supremo, charging the Spanish Government with inaction. The filing notes that, despite 80 days passing, no administrative expulsions have been carried out for the people who remained in the city. Ceuta asks the court to impose extraordinary precautionary orders without prior notice to the state, emphasizing the legal deadlines and the security-national interest status that ends on 31 December.

The city also demands that the central government allocate staff and material means to process expulsions, returns and asylum applications, while respecting individual procedures and the protection of minors. The appeal was approved unanimously by Ceuta's council on 16 September and submitted two days later to the Presidency, the Government Delegation and the ministries of Territorial Policy, Interior and Inclusion. The municipality warns that the prolonged crisis is harming its budget, public services and reputation.

Why it matters

The case could force the national government to act on pending migrant removals, affecting public resources and security in Ceuta.
