ICE re-detains Honduran immigrant charged with child sexual offenses after local release

Oscar Evaristo Nunez, a Honduran national illegally present in the United States, was re-arrested by ICE on Sept. 15 after a targeted enforcement sweep. Nunez's original arrest on Aug. 27, 2025, involved charges of aggravated sexual battery against children and the non-consensual recording of an undressed minor. Although ICE filed a detainer with the Fairfax County Adult Detention Center two days later, local authorities released him without notifying federal officials.
The case has become a flashpoint in the ongoing clash between the Trump administration’s immigration stance and Virginia’s sanctuary-leaning officials. DHS Secretary Markwayne Mullin condemned Fairfax County, calling the release a failure to protect public safety, while Governor Abigail Spanberger, who assumed office in Jan. 2026, has directed state agencies to end participation in ICE’s 287(g) program. Nunez, who entered the U.S. near Arizona in Sept. 2003, stays in ICE custody while immigration proceedings continue.
