ICE recaptures Honduran immigrant charged with child sexual offenses after local release

ICE detained Oscar Evaristo Nunez, a Honduran illegal immigrant facing child sex crime charges, following his release by Fairfax County officials who ignored an immigration detainer.

Oscar Evaristo Nunez, a Honduran national who entered the United States illegally around September 2003, was first taken into custody in August 2025 on charges of aggravated sexual battery against children and the non-consensual recording of an undressed minor. ICE filed a detainer with the Fairfax County Adult Detention Center, yet county authorities released him two days later without informing federal officials. After remaining at large, Nunez was recaptured on September 15 during a focused ICE enforcement action.

DHS Secretary Markwayne Mullin condemned the release, accusing Fairfax officials of “sanctuary” politics that jeopardize safety. Governor Abigail Spanberger, who assumed office in January 2026, has since ended state participation in certain ICE programs. Nunez now remains in ICE custody pending immigration proceedings.
