Minister Pełczyńska-Nałęcz quits and flags procedural flaws in Berek's tribunal appointment

Katarzyna Pełczyńska-Nałęcz left the Donald Tusk government and stepped down as Poland 2050 chair, citing doubts about Maciej Berek’s eligibility for the Constitutional Tribunal.

On Thursday, Katarzyna Pełczyńska-Nałęcz announced her departure from the cabinet of Prime Minister Donald Tusk and resigned as chair of the Poland 2050 movement. Her exit follows a split vote in the Sejm over abolishing two-term limits for municipal offices, a measure that divided her party’s MPs. In a leaked conversation, Pełczyńska-Nałęcz criticized the appointment of former minister Maciej Berek to the Constitutional Tribunal, noting he has not fulfilled the constitutional ten-year tenure as a legal adviser and has not yet taken the oath required by the president.

President Karol Nawrocki has expressed doubts about Berek’s formal qualifications. Tribunal president Bogdan Święczkowski responded that the matter will only become relevant if Berek completes the oath, and therefore no disciplinary action is currently warranted.

Why it matters

The resignation highlights internal dissent over a high-profile judicial appointment that may breach constitutional rules.
