Federal Court to hear challenge over revocation of ten Negri Sembilan exco members
Ten former Negri Sembilan state executive council members will argue before the Federal Court on Dec 16 that the ruler’s order to remove them was unconstitutional.
A group of ten ex-state executive council members from Negri Sembilan have lodged a legal challenge that will be heard by the Federal Court on Dec 16. Their notice of motion, submitted on Oct 14, names the state secretary and the state government as respondents and raises three constitutional questions about the interpretation of Articles 28, 38 and 40 of the 1959 State Constitution. They argue that the Yang Dipertuan Besar, Tuanku Muhriz Tuanku Munawir, lacked authority to revoke their appointments without the menteri besar’s counsel.
The ruler announced the dismissals on Sept 20, citing a breach of allegiance, and the decision was formalised in a gazette on Sept 24. Lawyers Datuk Wira Mohd Hafarizam Harun and Marisa Regina Mohd Aris Rizal confirmed the hearing date after a case-management conference with Deputy Registrar Azaraorni Abd Rahman. The outcome will determine whether the revocations are null and void under state law.
Why it matters
The ruling will clarify limits on the ruler’s power to remove state officials, affecting governance in Negri Sembilan.
