Delhi High Court asks police to answer IYC's challenge over protest denial

The Delhi High Court has ordered the Delhi Police to respond to the Indian Youth Congress's petition contesting the refusal to allow a rally at Jantar Mantar against Chief Election Commissioner Gyanesh Kumar.

The Indian Youth Congress sought permission to hold a protest at Jantar Mantar targeting Chief Election Commissioner Gyanesh Kumar, but the Delhi Police denied the request on October 1, citing unspecified concerns. In a petition, the IYC argued that the denial was purely procedural and infringed on constitutional guarantees of equality and peaceful assembly. The Delhi High Court, hearing the case before Justice Amit Mahajan, asked the police to provide a detailed response and to list the matter for a hearing on Tuesday.

Additional solicitor general Chetan Sharma, appearing for the police, requested additional time to obtain instructions. The court’s order emphasizes the need for the police to justify how the proposed rally of 100-150 participants could disrupt traffic, endanger safety, or disturb public order, despite the IYC’s willingness to comply with security and traffic conditions.

Why it matters
